Terms of Service

These Terms of Service ("Terms") govern your use of bynefit.org and related services provided by Bynefit Inc., a Georgia 501(c)(3) nonprofit organization (EIN 85-3107828) ("Bynefit," "we," "us," or "our"). By using our services you agree to these Terms. If you do not agree, do not use the services.

1. Use of Services

You may use Bynefit services for lawful, mission-aligned purposes. You agree not to misuse the services, attempt to disrupt them, scrape data outside of our public APIs, impersonate others, or use the services to harass or harm any person or organization.

2. Donations

Donations to Bynefit Inc. are processed by third-party payment processors (currently PayPal, via Bynli.com). All donations are final and non-refundable except in cases of demonstrated processing error. Bynefit is a 501(c)(3) public charity; donations are tax-deductible to the fullest extent permitted by U.S. law.

Bynefit reserves the right to decline or return any donation, including for legal, ethical, or mission-alignment reasons.

3. SMS / Text Messaging Terms

• Program description: Outreach, resource updates, event reminders, and program notifications from Bynefit Inc.
• Frequency: Message frequency varies. Typically fewer than 8 messages per month per opted-in user.
• Charges: Message and data rates may apply, depending on your carrier and plan.
• Opt-out: Reply STOP at any time to cancel.
• Help: Reply HELP or contact racean@bynefit.org.
• Carriers: AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, and most major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
• Data handling: See our Privacy Policy. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

4. Resource Directory & Open Data

The community resource directory is provided for informational purposes. Bynefit makes reasonable efforts to maintain accuracy but does not guarantee that listings are complete, current, or error-free. Always confirm hours, eligibility, and contact details directly with the listed organization. Use of the public API is subject to fair-use limits posted at the API endpoint.

5. Intellectual Property

The Bynefit name, logos, and original content on this site are the property of Bynefit Inc. You may share content with attribution for noncommercial, mission-aligned purposes. Open data published via our API is licensed for public benefit; please credit "Bynefit Inc. / Bynli" when redistributing.

6. Disclaimers

Bynefit services are provided "as is" without warranties of any kind, express or implied. We do not warrant that services will be uninterrupted, error-free, or secure. Bynefit is not responsible for the actions, services, or content of partner organizations listed in our directory.

7. Limitation of Liability

To the maximum extent permitted by law, Bynefit Inc. and its officers, directors, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the services. Our total liability for any claim shall not exceed one hundred U.S. dollars ($100).

8. Indemnification

You agree to indemnify and hold harmless Bynefit Inc. from any claims, losses, or expenses arising from your misuse of the services or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Fulton County, Georgia.

10. Changes

We may update these Terms from time to time. Continued use of services after changes constitutes acceptance of the updated Terms.
